“Cross-fertilisation of international commercial arbitration, investor-state arbitration and mediation: The good, the bad and the ugly?”

 PRESENTED BY:

Luke Nottage PhD, LLD

Professor of Comparative and Transnational Business Law, Sydney Law School

Prof Luke Nottage PhD, LLD presented the 6th ADR Address of the Supreme Court of NSW on the topic Cross-fertilisation of international commercial arbitration, investor-state arbitration and mediation: The good, the bad and the ugly? On 22 February 2024.

Prof Nottage is a Professor of Comparative and Transnational Business Law from the University of Sydney Law School and Special Counsel at Williams Trade Law. He specialises in arbitration, contract and consumer law, investment law and corporate governance, with a particular interest in Japan and the Asia-Pacific.

International commercial arbitration has grown increasingly common in the past few years, especially alongside investor-state arbitration. In his talk, Prof Nottage sheds light on the crossovers that are currently happening in med-arb and these international arbitration processes, and the importance of tracking this cross-fertilisation to ultimately reduce costs and delays in cross-border dispute resolution.

ADC welcomed students, barristers, solicitors, dispute resolution practitioners, and more in this broad-church event at the Banco Court. We extend our warm thanks to Luke Nottage for his insightful ADR Address and to The Hon. Chief Justice Andrew Bell for welcoming us all to the magnificent Ceremonial Court, as the Supreme Court prepares for its bicentenary on 17 May 2024.
