Season greetings to you in our variously sizzling, soggy and groggy Australian summer! With the festive season upon us, and ADC closing for its annual break, I extend my sincere thanks for your continued support and contributions in helping making 2021 another successful and memorable year.
In spite of the challenges of the pandemic, as a community we have demonstrated tremendous resilience and have ‘powered-on’ to deliver a year of incredible accomplishments, despite vaccinations, masks, tests and lockdowns (and all that again). I am particularly proud of my team here at the ADC, they have been exceptional throughout the year.
ADC opened 2021 in celebratory style with its 35th Anniversary Mediation Training courses. Our Mediation programme, Conflict Resolution & ADR, Negotiation, Facilitating Difficult Discussions and Bullying & Harassment Prevention have remained strong and ever-popular throughout the year, and we look forward to providing you another year of world-class professional development opportunities in 2022. Dates and details are in the Bulletin below.
ADC’s raison d'etre is to promote and support best-practise ADR across Australia and the globe. The online world has created new opportunities for our work and ADC has been thrilled to share its annual events, such as the Supreme Court ADR Address series internationally.

ADC was proud to again organise the ICC-ADC Asia-Pacific Commercial Mediation Competition 2021 in an online format. From the Sydney/ Melbourne lockdowns and homes across some 20 nations, ADC expanded the reach of APCMC 2021 and welcomed over 200 students and professional volunteers from SE Asia, the Pacific, Africa, Europe, the Americas and the Middle East. It was a melting pot of learning, networking and enthusiasm for the commercial application of cross-border mediation. Once again, my thanks to all the students and volunteers for their dedication, tremendous efforts and collegiality throughout the competition.
As another 35th Anniversary initiative ADC established its first professional Book Club in 2021, to help you stay current and connected! It’s never too late to join and this Bulletin includes a link for you to register over the break and join colleagues online in February for insightful discussions and BYO beverages!
In the New Year, we look forward to celebrating ADC’s 35th Anniversary and the 6th Annual ADR Awards at a special Gala Dinner. Please join us for this celebration as we kick off an exciting New Year, and recognise the tremendous efforts of our ADR colleagues.
Once again, I would like to express my thanks to all our valued friends, colleagues and clients, together with ADC’s Patron and Board, ADC’s Associates and Interns and our wonderful Training Faculty. Your professionalism, support and good grace throughout the year has made 2021 one to remember, and for all the right reasons!
I wish everyone a very Merry Christmas and a Happy New Year. Have a safe holiday, and I look forward to seeing you in early 2022 for another great year!

Conciliation: connecting the dots

For students and ADR practitioners alike, differentiating between facilitative mediation and the process of conciliation has always been somewhat hazy. Thus, we are excited to share the culmination of seven years work on conciliation by the Australian Dispute Resolution Advisory Council (ADRAC). ADRAC’s report was launched on 25 November 2021, Conciliation: connecting the dots. In its comprehensive research, ADRAC has explored basic assumptions of conciliation to understand its evolution and to suggest what might be changed to enhance conciliation as a dispute resolution process, including a comprehensive definition of “conciliation”.

Lessons from the Samurai: Maintaining Fluidity in Negotiations and Dispute Resolution
|
Negotiations and dispute resolution require quick thinking and strategic reactions to developing situations, dynamic relationships, and power shifting. Negotiation is seldom static. Peter Adler has analogised negotiation to jazz. Here Stephano Salani uses the analogy of the legendary samurai of feudal Japan. Stephano advocates for a well-prepared negotiation mindset that can interweave integrative and distributive approaches and fluidly interchange between the two as newly gathered information and changing circumstances arise. Conveniently, the strategies underpinning martial arts used by the samurai can be compared to the strategical mindset of negotiators using structured integrative and distributive approaches for a visualized assessment of how these approaches may be interwoven.

Pathways to Commercial Success in Latin America
|
The Australia-Latin America Business Forum was hosted by the Australian Disputes Centre as a hybrid event (in Sydney and online) on 14 December. Speakers from Australia and Latin America provided insights into challenges confronting cross-border trade between Australia and Latin America and tips to manage these risks.
