It is mid-winter and individually and collectively we continue our lessons in resilience as we respond to multiple challenges; health, climate, war, the economy. As we practise self-care and generosity of spirit, I hope it is inspiring to reflect on a few heartening stories in this Bulletin.
Coming out of ADC’s own Covid-19 isolation, we were uplifted on 27 July 2022 to meet one of the great grandfathers of mediation, Mr Bernard Mayer. Over the past 12 months ADC's Book Club has been reading Bernie Mayer’s work. Needless to say Book Clubbers were thrilled to meet the author in person and share a wide-ranging conversation on the art and angst of mediation.
In this Bulletin we share with you our recent review on what is new and inspiring in the uptake of mediation across the South Pacific. Advancing ADR is ADC’s raison d’être and over the past year ADC has further extended its pro bono programme in support of mediation in the Pacific. ADC has been working with two of the regions smallest nations and has trained 12 new mediators over 12 months.
Locally, we are excited to have Judge Katrina Bochner present the 4th Annual ADR Address of the Supreme Court of South Australia on 11 August. 2022. This is a hybrid event, so please join us in person in Adelaide or join us online from wherever you are.

Also coming up on 11 August, we have the 9th annual ADC Schools Debating Competition. This year the programme has been extended beyond NSW to other states and territories and we are delighted to host our first Year 10 national debating competition. This is a unique competition and it is truly inspiring to watch the young teams' build internal cohesion, network, collaborate and develop their personal powers of persuasion.
From 28-30 August 2022 we host the ADC-ICC Asia Pacific Commercial Mediation Competition for university students across the region. The APCMC is an exciting event involving the regions' top ranking students and a brilliant cadre of international ADR professionals who offer their time pro bono to mediate and/or judge across the three day competition.
I encourage you to get inspired by volunteering for these programmes; coaches/adjudicators for the schools debating, and judges/mediators for the APCMC. Brighten up your winter with these wonderful pro-bono opportunities; working with our young dispute resolution and business leaders of tomorrow while networking with peers. Using a few wintry days for your own professional development can also cheer your heart with a sense of pride and achievement. ADC’s mediation training and refresher program is second to none. With significantly more coaching hours than is required under the national mediation standards, you can be assured that your professional skills will be well honed leading into spring. This spring ADC is launching a brilliant, new course for Expert Determiners. Its focus is on commercial matters. I encourage all those seeking to extend their skills and access this incredibly interesting and lucrative dispute resolution work to join the course in October. The Australian Disputes Centre is proud to present the 4th annual ADR Address of the Supreme Court of South Australia.
Australia‘s Supreme Courts have been at the forefront of utilising Alternative Dispute Resolution (ADR) processes for many decades, as an alternative to progressing disputes through to a contested hearing. The resultant savings to the the disputing parties and the South Australian Government, in time and money, are significant.
This Thought Leadership Series explores a range of current ADR related issues, including the application of these processes in and out of the Courts.

ADC Book Club Meets the Author
|
After gathering every 2 months over the past year to discuss the rich content of Bernie Mayer's ‘Staying with Conflict’, ADC’s book clubbers were thrilled to wrap up their year in meeting their favourite author and mediator, Bernie Mayer. Joining from Toronto, Bernie was similarly delighted to meet his readers, answering their questions and discussing what they had found helpful in Staying with Conflict and what was more challenging.
Bernie is a dispute resolution and peace-making legend with a deep store of insights drawn from decades of experience. In a wide-ranging conversation, Bernie spoke with the group about the role of the mediator in helping people to solutions (or not), facilitating conversations in situations of power imbalance, allowing sufficient time for decision-making and the benefits of taking more risks as mediators in helping people ‘dig deep’ to understand and communicate their needs. It was a thought provoking discussion that inspired the Book Club to reflect on their own practices.
ADC thanks Bernie for his generosity in meeting with the Book Club, our Book Club facilitators Annebelle Davis and Lisa Frisken, and our ADC book clubbers in contributing to this great Book Club journey.

Expert Determination – One Day Course

With the increasing use of Expert Determination there are new appointments awaiting those who are prepared.
Although experts instinctively feel that as experts they would have no problems with determination, the reality is rather different – technical/professional expertise alone is not sufficient. There are many pitfalls which need to be avoided and procedures and doctrines which must be followed.
This is a course which will deal with what you need to know to get started and conduct an Expert Determination.

The APCMC is a brilliant opportunity for students to hone their negotiation and public speaking skills, in addition to their analytical judgement and power of persuasion. ADC Schools Invitational Debating
|
The Australian Disputes Centre’s Schools Invitational Debating Competition is a unique opportunity for year 10 students to learn and develop their debating and collaborative skills. This is a pro bono competition offered to public and private schools. Students compete in mixed school teams.
Debating teaches students how to find their voice, communicating their thoughts and ideas as a public speaker, how to think on their feet and effectively construct a persuasive argument.
ADC’s Schools Invitational Debating Competition is expanding nationally in 2022. We are seeking a few more volunteer coaches and adjudicators to assist us with this online competition. Mediation in the South Pacific Islands

The Australian Disputes Centre has been working in the South Pacific for many decades. In the early years ADC collaborated with Macquarie University in training mediators in Fiji. Since 2015, ADC has been running an annual mediation training program in Suva for all South Pacific counties. In a pro bono initiative over the past year, ADC has brought the Pacific online and trained 12 new mediators in 12 months for two of the region’s smallest nations.

Facemasks as a Barrier to Effective Communication

Facemasks are variously encouraged or mandated in many indoor settings where social distancing is not possible. With COVID-19’s ongoing health impact, masks seem here to stay for the foreseeable future. Accordingly, dispute resolution specialists are needing to recognise the impact of wearing facemasks and facilitate improved communication in the context of this added challenge.
