What a year it has been. I hope that you and your families have remained safe and well. We all have different fears about the various roadmaps out of our lockdowns and border closures, let alone mask-wearing. But we coalesce around the common goal of closing out 2021 on a note of hope as we look forward to many more freedoms in 2022. In troubled times, disputes will invariably follow, and we can expect that the need for ADR will continue to grow over the next few months and well into next year.
It is timely to take stock, reflect on all the work that you and others have accomplished over the past 12 months and recognise these successes. The Australian ADR Awards celebrate excellence in the sector, across 24 categories. A BIG reminder from me that nominations in the ADR Awards 2021 are due on Friday, 15 October. I look forward to the industry recognising practitioners and ADR groups for excellence in the field.
We are ready to celebrate! Please ‘Save the Date’ for 17 February 2022, for the ADR Awards Gala, together with ADC celebrating its 35th Anniversary. Or even better, ‘Book your Table’ early. It will be a big event and tables are limited.

It was tremendous to have over 250 dispute resolution practitioners register for the 4th Annual ADR Address of the Supreme Court of NSW last week. Justice Julie Ward’s Address on ‘Online Dispute Resolution in the Age Covid-19’ was topical, wise and witty. For those who missed the simulcast, our Bulletin’s Special Rapporteur on the topic provides an overview of Her Honour’s Address and later in the Bulletin dives into what others are thinking about the future of ODR.
For those of you who have matters that prefer to meet in-person, ADC’s rooms at 1 Castlereagh St, Sydney are re-opening on 1 November 2021. Everyone attending will need to be fully vaccinated. I encourage you to book early, as we expect to be very busy leading into Christmas.
ADC continues its Thought Leadership events with a focus on Australia-Latin America Business Forum in November. There are multiple issues confronting Australian business interests in Latin America, and we garner insights from business and dispute resolution experts from both sides of the Pacific on how these risks can be best managed.
Building professional connections, maintaining a reflective practice and accumulating your NMAS CPD points in a relaxed environment is the stuff of ADC’s Book Club groups. Our next Book Club kicks off on Monday, 18 October and I encourage you to sign up via the Bulletin below.

Australia Arbitration week coming up, 18 – 22 October 2022. ADC’s contribution to this annual event has for many years been a country or regional focus, most recently Australia-Africa Entente Cordiale, The Business of International Commercial Arbitration [2018], Beyond Googlies and Cricket, India and Australia Trade, Investment and Successful Dispute Resolution [2019], and while Arbitration Week did not go ahead in 2020, ADC held a follow-on event to its focus on India with Peter Varghese AO presenting An India Economic Strategy to 2035.
In 2021, ADC is turning to Latin America. This event is now being held post Arbitration week:
Latin-America is a growth market for Australian trade and investors. This event presents a real-world view of issues confronting Australian business interests in Latin America, with insights from business and dispute resolution experts from both sides of the Pacific on how these risks can be best managed.

Arbitration Environment in India: From the Users’ Perspective
|
With opening itself to globalisation and foreign investment, India is eying to become a global hub for commerce. Arbitration, as a quasi-judicial system, is increasingly be used in responding to the concomitant commercial disputes that arise from this increased trade and investment.
In this fascinating article Rajat Singla, an India-based engineer and Masters of Law candidate at UNSW, interviews users and experts of arbitration. The focus is on professionals from the Indian civil infrastructure industry who have experience in dealing with construction disputes in Indian arbitrations. Following the ‘life cycle’ of a dispute Rajat explores their challenges and insights on the Indian arbitration system.

Is Online Dispute Resolution here to stay? – The Opinion of ADR Practitioners and Clients
|
As of October 6th 2021, 89% of New South Wales residents and 83% of Victorian residents have had their first COVID-19 vaccination.[1] With two of Australia’s most populous states scheduled to exit lockdown by December, face-to-face Alternate Dispute Resolution (ADR) sessions will once again be an option for many Australians.
The question for practitioners is whether clients will return to traditional ADR post-lockdown, or is Online Dispute Resolution (ODR) here to stay? Our special rapporteur on the impact of COVID-19 explores the issues and current views on ODR.

It has been an exciting year for the Australian Disputes Centre and a major highlight has been the 5th annual Asia-Pacific Commercial Mediation Competition. Opened by the High Commissioner for Singapore and running across three days in early September, the event drew over 100 students and coaches from 26 teams across 10 countries. Teams competed over three preliminary rounds that were mediated and judged by over 60 professional mediators from 15 countries. Students and judges were able to connect with their peers through multiple networking events.
The Grand Final between the University of Auckland and West Bengal National University of Juridical Sciences was a display of exceptional skill. Both teams were examples of best practice and navigated the challenging problem scenario in a professional, creative and conciliatory manner. We look forward to hosting next years’ competition, which is set to be bigger and better than ever!

The ADC Book Club features a reading list designed to enrich your dispute resolution knowledge and expertise, in relaxed book-club setting. This is a great way to stay current, keep-up your CPD points for mediator re-accreditation and extend your professional connections.

Book Club sessions are attended by our Book Club curators (ADC training faculty) and involve discussions drawn from the diverse professional and life experiences of your group members. The Book Club groups meet every 2 months. CPD points apply.
