Downunder, we are past the shortest day of the year, but it is still mid-winter. Yet far from suffering the chills, much of Australia thinks it is springtime. ADC is delighted to help you keep that spring in your step over the coming weeks with several incredible events across the country - and all are complimentary. Now is a great time to reignite those networks and stay current.
In Sydney (and simulcast) we are honoured to be joined by senior figures from across the Asia-Pacific on 27 July. We welcome Shane Prince SC from State Chambers in Sydney, Wejun Wang, Secretary General of Shanghai International Arbitration Center, Steve Kim from the Korean Commercial Arbitration Board, Prof. Dr. Francis Law Chairman of the Hong Kong Chinese Industry and Commerce Association and the Hong Kong International Mediation Centre and Wee Meng Chuan, CEO at the Singapore International Mediation Centre (SIMC). This illustrious panel will explore the potential for growth of ADR hybrid models to accommodate the increasing complexity of cross border commercial relationships.
On 2 August 2023, in Darwin, we are collaborating with Chief Justice Michael Grant in presenting the ADR Address of the Northern Territory, and we are honoured to have Attorney General, The Hon. Chanston Paech MLA, delivering this year’s address. Mr Paech’s ADR Address will be broadcast by First Nations Broadcasting and we thank them for their generous support.

On 10 August in Sydney (and simulcast) we have Tony McAvoy SC speaking on The Voice. As a Wirdi man from Central Queensland, a senior barrister, a strong advocate for First Nations people across Australia and a member of the Federal Government’s Referendum Working Group and Referendum Engagement Group on a First Nation’s Voice to Parliament, Tony brings a deeply informed perspective to an issue of enormous currency.
We are seeing Expert Determination used increasingly and on 28 September, we have the multi-award winning John Rundell presenting a one-day CPD course for those who are practising in the field and those who would like to move into the sector.
Published below, we are grateful to Peter Keel for his keen insights into the mediation process that draw on many decades of legal and mediation experience. Also in this Bulletin, Rohit Ray, an ADC intern from West Bengal National University of Juridical Sciences, reports on the fascinating topic of mediation in Morocco and Algeria.

We are honoured to have the Attorney General present the annual ADR Address of the Supreme Court of the Northern Territory. ADC’s Supreme Court ADR Address Series aims to develop a community-wide understanding of access to justice and the benefits of timely and cost-effective dispute resolution. This is a broad-church event, and we extend a warm invitation to Parliamentarians, community leaders, government officials, academics, university and high school students together with all those from the dispute resolution sector; the Judiciary, barristers, solicitors and ADR practitioners.

Anthony (Tony) McAvoy SC is a Wirdi man from the Central Queensland area around Clermont and is Australia’s first Indigenous Senior Counsel, appointed in 2015. Tony chairs the NSW Bar Association First Nations Committee and co-chairs the Law Council of Australia’s Indigenous Legal Issues Committee. In 2022 he was appointed to the Federal Government’s Referendum Working Group and Referendum Engagement Group on a First Nation’s Voice to Parliament.

Mediation in North Africa: the evolution of traditional values in a diverse contemporary context
|
Northern Africa is not new to mediation as a form of dispute resolution, as the concept comes from principles engrained in Islam, established in the Holy Quran and Hadith. The concept of Sulh denotes amicable dispute resolution using methods like negotiation, mediation, and arbitration, and represents the ideal way of progressing through conflict.
