ADC Bulletin – Issue 5 – July 2016
Welcome to our July Edition of the Bulletin  
 
We are mid-way through 2016 and it has been a whirlwind of activity for ADC in our 30th Anniversary Year. Over the past few months we have been out in the world promoting Australia in Africa and to the other hundreds of arbitrators from around the globe who gathered in Mauritius for the 23rd ICCA Congress. ADC has also been in the South Pacific running a highly successful regional mediation training program. Closer to home, ADC raised a call to action on the backlog of Land Claims in NSW. Read more below on this important issue and what ADR can do to assist.

In April 2016, ADC launched the Australian ADR Awards in recognition of excellence of all Australian based Mediation and Arbitration practitioners and practice groups. These broad-based national ADR Awards recognise individual excellence, promote strong industry standards and advance Australia’s profile internationally. We encourage practitioners to self-nominate or submit nominations for colleagues. You will need to Act Now! Nominations close on 15 July 2016.

For ADC there have been recent Board movements. After nearly 5 years as Chairman, Michael Talbot thought it timely to see a fresh face in the role. Michael has stepped down and passed the baton to fellow Director and Deputy Chair, John Wakefield. The ADC staff extends their warm congratulations to John on his appointment and our great thanks to Michael for his leadership of the Board. Personally it has been an enormous pleasure to work with Michael over the past few years. I have greatly valued his clarity in setting ADC’s strategic direction, his focus on good governance and his unwavering support and wise counsel. Thank you Michael and we wish you much success in the next phase of your stellar career.

Many readers of this Bulletin have had an association with ADC over decades. Your support has helped us build an organisation that stands for confidence and innovation in advancing access to justice through timely and cost-effective dispute resolution. ADC has achieved a great deal through the energy and hard work of several ‘generations’ of dedicated employees and we could not have done it without your support. It is time for us all to celebrate! ADR Practitioner Recognition Awards Nominate Today!


In celebration of 30 years advancing ADR, the Australian Disputes Centre has launched the inaugural Australian ADR awards to recognise excellence in the practice of mediation and arbitration; both domestic and international.

ADC Benefit Ball & Awards Night

 
ADR in Australia has made great strides over the past 30 years. ADC, together with many other organisations and individuals, has been at the forefront of advancing the practice and skills of ADR and as an industry we can be rightfully proud of the hundreds of thousands of disputes we have helped to resolve in a private, timely and cost-effective manner.
 
At ADC’s 30th Anniversary Ball & Awards Night on 13 August 2016, ADC is saying thank you to everyone who has contributed to the success of ADR in Australia. We also take the opportunity to recognise the many practitioners who have demonstrated excellence in the field.
 
In celebrating our collective achievements we also recognise that there is still much work to be done and Australia’s inaugural Benefit Ball is dedicated to the next generation of ADR practitioners who will be working in support of Aboriginal and Torres Strait Islander organisations and communities across Australia; mediating the resolution of disputes.

ADC Board Changes

 

Michael Talbot retires as Chairman

 
Michael Talbot steps down as Chairman but will remain on the Board. The ADC Board and staff thank Michael for his significant contribution as Chairman over the past 5 years. Michael has provided a clear vision and a steady hand in guiding ADC during his term as Chair. During Michael’s Chairmanship he successfully lead ADC through a corporate rebrand (2015), a major integration program following the opening of our Centre at 1 Castlereagh Street (2011) and a broad range of other strategic initiatives in support of ADC’s national and international objectives.

ADR in Australia and Australia’s profile internationally, have been significantly advanced during Michael’s time as Chairman and we are grateful that he will continue on the Board.
 

John Wakefield Appointed Chairman

 
John Wakefield, formerly Deputy Chair, has been appointed as Chairman of the Board. John brings a wealth of legal, managerial and ADR experience to this strategic role and ADC is delighted that he has accepted the role of Chairman.

John is the Managing Partner of Holman Webb Lawyers and practices in State and Federal Courts in securities enforcement, insolvency, insurance and re-insurance, trade practices, general commercial and equity and in international and domestic arbitration.

He is a Fellow of the Chartered Institute of Arbitrators and from 2010 to 2013 was Chair of the Australia branch. John is a Fellow of the Australian Centre for International Commercial Arbitration (ACICA), and the independent member of the ACICA Appointment Committee. John is a qualified mediator (NMAS) and teaches, writes and speaks regularly on issues in alternative dispute resolution. In 2009, John was appointed a judicial member of the Administrative Decisions Tribunal of New South Wales. Since 2014, he has been a senior member (part-time) of the NSW Civil and Administrative Tribunal sitting in the Administrative and Equal Opportunity and Occupational Divisions and on the Appeal Panel.

John’s expertise, enthusiasm and clear vision for ADR in Australia have been a hallmark of his role on the ADC Board and we are delighted that John now joins ADC as Chairman.

Access to Justice;
India’s ADR response

Recent years have seen remarkable growth in the trading relationship between India and Australia. Two-way trade in goods and services has grown in value from $6.8 billion in FY2003-04 to $14.8 billion in FY2013-14. The Australian Government has marked the Comprehensive Economic Cooperation Agreement (CECA) as one of its key priorities; its Trade and Investment Minister Andrew Robb visiting India four times in 2015 to bring negotiations to an early conclusion. Five Nations in Collaboration

South Pacific Mediation Training Program




ADC’s recent mediation training and accreditation course in Suva was a five nation regional success story with attendees from Kiribati, the Solomon Islands, New Zealand and Fiji working together with Australian trainers to hone their mediation skills. ADC thanks its amazing Australian training faculty who together brought over 100 years experience and enthusiasm to the course. Mauritius 2016 – Sydney 2018

 

 
ADC’s Deborah Lockhart and Deborah Tomkinson travelled to Mauritius in May to take part in the 23rd International Council for Commercial Arbitration (ICCA) Congress. This was the first time in ICCA’s 50-year history that the Congress gathered in Africa, demonstrating the important role that international commercial arbitration now plays across the African continent. The Congress met from 8-11 May 2016 to present papers from leading experts and allow for discussion and exchange of ideas from international arbitration partitioners and users to enhance understanding and shape developments in the field.
 
The next ICCA Congress will meet in Sydney, Australia 15-18 April 2018 hosted by ADC’s hub partner the Australian Centre for International Commercial Arbitration (ACICA).  More information can be found here »

Backlog of NSW Land Claims

The relationship between Land Rights and Native Title is legally complex and the volume of Land Rights Claims is significant. To help us understand what is happening in this space, ADC invited three of Australia’s leading specialists in the field to discuss the legal frameworks underpinning Aboriginal land rights claims, the unique issues experienced and what ADR can offer.  Helen Shurven, Member, National Native Title Tribunal, Steven Wright, Registrar, Aboriginal Land Rights Act, and Tony McAvoy, Senior Counsel, Frederick Jordan Chambers shared their significant expertise with an audience of prominent practitioners and NSW government officials about the challenges and possible solutions in this area. Read the full article here»
