Word from the CEO Welcome to our June edition of the ADC Bulletin. It is Awards’ season and an opportunity for us all to catch our breath, and reflect on the tremendous contributions that you and others have made over the past year to excellence in the field of ADR.
Many of you will already be focussed on completing your nominations in these 4th annual Australian ADR Awards. Others may still be considering nominating. I encourage you all to get involved in recognising the individuals and the teams that contribute so much to the lives of so many people every day. On 30 May 2019, ADC and Territorians were honoured to have The Hon. Chief Justice Michael Grant open our 2019 Supreme Court series, with his thought provoking ADR Address in Darwin. My thanks to Grant CJ for his insightful comments, and to the many Parliamentarians, lawyers, government officials, academics, indigenous leaders and students who attended this important event. In 2019, ADC continues its mission in passionately promoting ADR across Australia and internationally. It is a privilege to be expanding our Mediation & Conflict Resolution courses in regional centres during 2019, including the upcoming Cairns and Alice Springs programs.
Coming up in July, ADC turns its dispute resolution lens on the Abrahamic faiths. What is the role of ADR? What more can we be doing? This Panel Event will be simulcast nationally. Please join our faith leaders in discussing issues central to community cohesion and global peace.
The ADC Bulletin has not traditionally included an ‘industry moves’ section. However, with three industry leaders recently announcing that they are stepping down from their respective roles, I would like to extend my personal thanks for their significant contributions to ADR in Australia, New Zealand and internationally. Alex Baykitch has recently stepped down as President of ACICA, with Brenda Horrigan being appointed into that role. Deborah Hart (AMINZ) and Fiona Hollier (Resolution Institute) have each recently announced that they will be leaving their roles as CEO’s within a few months. My warm thanks to Alex, Deborah and Fiona for their support, collaboration and friendship over many years. While hopefully they are not moving too far afield, they will each be missed from their important roles in the ADR industry. My congratulations, and a warm welcome to Brenda as President of ACICA.
As part of its Thought Leadership initiatives, ADC has been researching how technology can best support the practise of ADR. We have also been looking at the complex challenges of environmental disputes and the opportunities for more effective ADR mechanisms. I am thrilled to bring you our research findings on both these topics in this edition of the Bulletin.

Launching the Northern Territory’s Supreme Court ADR Address series on 30 May 2019, the Honourable Chief Justice Michael Grant discussed ‘The Interaction between the Courts and Alternative (or Assisted) Dispute Resolution’. Chief Justice Grant brought an insightful perspective to the ever-expanding relationship between ADR processes and the courts, with a uniquely NT frame. With the Aboriginal and Torres Strait Islander populations expected to reach majority in the NT by 2040, Grant CJ highlighted that this shifting demographic will require significant development in culturally appropriate ADR processes. One can anticipate that the Courts will be at the forefront of these changes.
Our commitment: Mediation Training in Indigenous Communities At the Australian Disputes Centre, we are committed to promoting the strength and importance of Alternative Dispute Resolution mechanisms across Australia. In line with this mission, we provide ADR training for Aboriginal and Torres Strait Islander communities throughout Australia, with the core vision of enhancing access to justice, and promoting timely, cost effective and culturally appropriate dispute resolution.
ADC’s courses have been specifically tailored to provide training that incorporates an indigenous lens, in order to accommodate the different values, cultures and traditions of ATSI communities, while also addressing cross-cultural factors and power imbalances that can lead to unresolved conflict.
Speakers Panel clockwise from top-left: International Arbitration in Practice On 21 March 2019, ADC proudly hosted a comprehensive ‘how to’ seminar on International Commercial Arbitration in Practice in collaboration with ACICA and colleagues from around Australia. Due to the multi-jurisdictional nature of modern disputes, the uptake of Arbitration is growing, and it will often at the forefront of the ADR mechanisms being used, particularly in areas such as trade, construction and maritime disputes. This stimulating event was attended nationwide by over 150 barristers, solicitors, mediators and aspiring arbitrators.
The prestigious Speakers’ Panel included Australian Arbitrator of the Year 2018, Peter McQueen; Jo Delaney, Partner at Baker McKenzie; Daisy Mallett, Partner at King a Wood Mallesons, and Greg Laughton SC from 13 Wentworth Selborne Chambers. James Morrison, Counsel at ACICA deftly MC’d our Panel and online questions from around Australia.
Online Dispute Resolution and the way of the future: eHearings, eArbitrations and more The impact of technology to different areas of Dispute Resolution and Litigation practice cannot be denied. The interest in technology, and increasing reliance on technological solutions is well-documented, there is limited information available as to how technology is used on a day-to-day basis by ADR practitioners. There is also a gap in the literature onhow technology is used to address the needs of specific practice areas, particularly dispute resolution.
