A word from the CEO

ADC’s recent events have provided unique insights into the contemporary world of ADR, including recent developments and current challenges. We began our 2018 Seminar Series in February with an insightful address by The Hon. Justice Robert McClelland that valuably illustrated the duty owed by the modern lawyer to the court in the administration of justice. The evolving expansion of ADR in Australia, including the increasing role of technology in the area, was further discussed by The Hon. Chief Justice Wayne Martin in the inaugural ADR Address at the Supreme Court of Western Australia in March. Links to both of these significant Addresses are in this Bulletin.

These important conversations, bringing in key figures from across Australia and internationally, will

continue across the country and throughout the year, allowing you the opportunity to keep up with developments in ADR.

An extremely important discussion is just weeks away at the Biannual ICCA Congress in Sydney and we encourage those engaged in arbitration and those wanting to know more, to come along and learn from a diverse range of global ADR leaders. ADC and our Patron, The Hon. Robert French AC will farewell Congress speakers and delegates at a Reception at the Australian Disputes Centre. Mr French will also be speaking in various cities around Australia during 2018 at ADC’s not-to-be-missed Symposium Series.

Finally, nominations are opening soon for the 3rd Annual Australian ADR Awards. We have a new category in 2018, ‘Innovation in ADR’, and we invite you to nominate early, for one or more categories.

ICCA CONGRESS 2018

15-18 April 2018

The International Council for Commercial Arbitration (ICCA) Congress is the world’s premier biennial International Commercial Arbitration conference offering the highest calibre programming and attracting delegates from around the globe. In April 2018, this conference will be hosted in beautiful, sizzling Sydney followed by spectacular Queenstown.
ICCA 2018 is a significant event for ADR in Australasia and is co-hosted by ICCA, the Australian Centre for International Commercial Arbitration (ACICA) and the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ).

Reasonableness – a fundamental aspect of a lawyers’ duty to the court and the administration of justice.

“Most lawyers instinctively and admirably fulfil their obligation to the court and the administration of Justice… One element of that duty, however, includes the obligation to act reasonably in attempting to resolve and/or narrow issues in dispute both prior to and subsequent to commencing litigation.

As noted by Allsop P, as he then was, in Aiton Australia Pty Ltd v Transfield Pty Ltd, engaging in genuine and good faith negotiations “requires the honest and genuine assessment of rights and obligations” of the respective parties.”

The Hon. Justice Robert McClelland launched ADC’s Seminar Series on 8 February 2018.
His Honour’s key messages resonated with the large audience of senior barristers and solicitors, ADR practitioners, young lawyers and students. Commenting on the issue of ‘genuine steps’ Geri Ettinger, Mediator and Tribunal Member at the Workers Compensation Commission, NSW, noted that ‘the intention of genuine steps is fantastic, but in reality it needs more work – people are just ticking the box’.

Alternative Dispute Resolution - a Misnomer?

"The rapid development and success of ADR belies any inference that it is some kind of lesser, or inferior, or less frequent system of dispute resolution. Its place as the primary means of dispute resolution is well established and it is inevitable that the role of ADR will be developed and expanded, particularly with developments in the area of IT to which I have referred.”

Our warm thanks to the Chief Justice and the Court’s officers for their support as well as to all those who attended the Address and reception that followed.

Australian Antarctic Diplomacy - Ice Breaker Shirase Reception

Antarctica is known as the World’s last wilderness. A place dedicated to peace and science. Antarctic diplomacy is renowned for the international cooperation and scientific collaboration it fosters globally. Chief Justice Tom Bathurst, ADC’s CEO Deborah Lockhart, Prof Luke Nottage from the University of Sydney, and Annebelle Davis from the ANU recently shared an evening of cultural and scientific exchange as guests of this season’s Japanese scientific expedition aboard the Icebreaker Shirase.
